Legal Authority Absent in Novel Baswedan Case: Legal Observer

IDNEWSNOW.COM, Jakarta Legal Culture Institute director M. Rizqi Azmi said Indonesia’s legal authority had vanished in the legal proceedings on the acid-attack against KPK investigator Novel Baswedan. He argued many irregularities had emerged throughout the court hearings. 

Azmi gave an example of the initial charge made by the public prosecutors against Novel Baswedan’s attackers, Rahmat Kadir Mahulette and Ronny Bugis, of up to one year’s imprisonment, which already signaled the final court verdict. 

“The prosecutors already framed the case in the public law logic suggesting it was actus reus and mens rea which is not an extraordinary event,” he explained on Friday. 

Even though the actual judge verdict handed 2 years’ and 1.6 years’ imprisonment for the two suspects, the Legal Culture Institute Director said it was nothing to celebrate.

Another oddity he thought had emerged in the court proceedings was that the law the charges were based on could charge an individual for a maximum imprisonment of 7 years, which is far below what had been handed to the two attackers.

He believed the judge should view the case as a severe legal violation against the KPK investigator, and that justice should be upheld despite external pressures.
